General Terms, Policies & Conditions

Please find below our Terms and Conditions for Active Retreats. Please read them carefully and do not hesitate to contact us if you have any questions. To be able to Participate in the Active Retreat, you must agree to the following Terms and Conditions, be at least 18 years of age, have a valid passport, and be able to travel to the destination independently. Flights are not included. By registering for the Active Retreat, you acknowledge that Active Retreats does not make any representation, warranty, or guarantee as to whether you will ultimately attain a cure for any health condition or disease. Any dispute arising over our contract will be dealt with under English Law. Our Terms do not affect your statutory rights.

Reservation and Payment:

To reserve your place at the Active Retreat, please contact aleksandra.miciul@olympian.org and submit the deposit.

By registering for the Active Retreat, you are stating that you agree to the Terms and Conditions. All health issues, including allergies, MUST be disclosed at the time of booking.

Active Retreat Payment, Cancellation, and Refund Policy

1. Deposit:

Deposit is a non-refundable £500 per person sum that is required to secure your booking. Due to the limited availability, deposits are non-refundable after the first 24 hours have elapsed since the booking time. All balances must be paid 30 days prior to the Retreat start date (by October 7th, 2024), at the most. Failure to complete all payments by the due date will result in loss of entry to Active Retreats, and no refunds will be given. We highly recommend holiday insurance for all clients. This must be bought independently as it is not included in the retreat price. It is your responsibility to read and understand the cancellation policy before making a reservation. Please consider purchasing travel cancellation insurance.

2. Guest Cancellations Policy (Cancellations made by the Guest):

If you need to cancel your Active Retreat booking, cancellation fees will apply. All cancellations must be received in writing and emailed to aleksandra.miciul@olympian.org.

Any promotional inclusions (such as products offered) will be deducted from any refund if applicable.

If for whatever reason you need to cancel your retreat place, the following refund policy will apply:

  • If you cancel within 24 hours of booking: Once you have confirmation of your booking, you have a further 24 hours to cancel and obtain a full refund, including the deposit. After this period, the following conditions will apply:

  • 90 days or more (before 07.08.2024): A full refund minus the deposit of £500 per person will be provided for all cancellations up to 90 days prior to the start day of the Active Retreat.

  • Between 89-30 days (08.08.2024 - 07.10.2024): A 50% refund will be provided on cancellations between 89-30 days prior to the start date of the Active Retreat. This excludes the £500 per person booking fee, which is non-refundable.

  • Less than 30 days (From 08.10.2024): No refund will be provided on cancellations between 30-0 days prior to the start date of the Active Retreat. Cancellations less than 30 days before the start date are non-refundable and will result in a 100% cancelation fee.

  • No refund will be provided for late arrivals, premature leaving of the retreat, or failure to arrive at the retreat for any reason.

  • No refund will be provided for only part of a booking; for example, if a room is booked for two guests who are sharing and one guest is unable to attend, the booking would need to be canceled as a whole for the above refund policy to apply.

Full payment for the Active Retreat must be completed no later than 30 days before the start date of the retreat (07.10.2024). Clients whose balances are not received by the 30-day deadline risk forfeiting their retreat booking.

3. Cancellations made by Active Retreats:

We reserve the right to cancel or postpone a retreat at our sole discretion. If we cancel or postpone a retreat, we will make reasonable efforts to reschedule it within twelve (12) months from its original start date. Booking fees paid by guests for a canceled or postponed retreat shall be applicable to the rescheduled retreat on a British sterling pound (GBP) for British sterling pound basis only.

Retreat venue, dates, and locations are subject to change without prior notice. We reserve the right to change any and all instructors for the retreat without notice.

If for any reason Active Retreats must be canceled, guests are entitled to transfer their payment to the next Active Retreat or get a full refund. Active Retreats will refund the retreat cost if applicable. However, please note that we do not cover expenses incurred for flights or other transportation methods.

If the retreat is canceled due to forces beyond our control, such as adverse weather conditions or other force majeure events, Active Retreats shall not be held liable to refund any monies paid; however, we will do our best to fairly resolve the situation.

We strongly advise that guests purchase trip cancellation insurance that includes trip cancellation protection and emergency medical expenses immediately after paying for the booking to cover their non-refundable payments in the event of cancellation due to personal or family illness, injury, or other unforeseen circumstances. The policy should also cover cancellation due to adverse weather conditions, natural disasters, and other events beyond your control. We will not be liable for any injury, illness, or loss resulting from a guest’s failure to obtain travel insurance. You are responsible for your own safety.

4. Code of Conduct:

Active Retreats reserve the right to ask you to leave the retreat if your behaviour is deemed inappropriate, unacceptable or offensive to others or the property. This includes but is not limited to being intoxicated, under the influence of drugs, abusive, threatening, racist, or inciting acts of violence or damage. If you are unhappy with anything during the retreat, please give us the opportunity to rectify it while you are with us. Raising issues on your return means nothing can be resolved (no refund shall be given).

5. Indemnity:

You agree to fully indemnify, without limitation, any trainer(s), director(s), or contractor(s) against any injury, malpractice, mishap, or accident occurring during any and all interactions with Active Retreats, whether away from or at the primary place of business.  Additionally, you agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties as set forth herein; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the site with whom you connected via the site. Despite the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate, at your expense, with our defense of such claims. We will make reasonable efforts to notify you of any such claim, action, or proceeding subject to this indemnification upon becoming aware of it.

Brochure and Website Content:

While we strive for accuracy in the information provided in our brochures and on our website, please note that content may change occasionally, often due to actions by our suppliers (e.g., hotels, tour companies, car rental agencies). We will make every effort to inform you of any changes affecting your holiday.

Comments and Complaints:

If you feel unwell or are not happy with the retreat for any reason, please contact the Retreat Manager immediately, and we will endeavour to take whatever action is required. Please bear in mind that any claims may be rejected if we are not given the opportunity to put matters right during your stay.

Payments at the retreat:

Please note that payment for items at the retreat such as additional treatments, taxis, some food and beverage, etc., can only be paid for by debit or credit card or Euros.

Flights and Transfers:

Flights must be booked independently, following confirmation of your retreat stay. If booking online, please await confirmation from the team before booking any flights.

Transfers from and to the airport: Guests are responsible for booking the transfers independently. We will provide insight and advice on local transportation methods.

Room Damages:

If you damage your room or any of the property within your room, you will be fully responsible for the entire cost of repairing / replacing / redecorating from your registered card.

Room Share:

If you select a ‘share with unknown guest’ room share option, then Active Retreats takes no responsibility for the actions of the person/s with whom you ‘room share’. If for whatever reason you are unhappy with your ‘room share’, including but not limited to: clash of personalities; disagreements; snoring; other annoying habits etc., Active Retreats cannot be held responsible. Please note that if you have booked a ‘share with unknown guest’ online, we can guarantee that you will be sharing with an individual of the same sex, unless otherwise specified.

Active Retreats will not accept liability for:

- Any of the events beyond our control.

- Loss, injury, or damage (to you) or your personal property.

- Physical, medical, or psychiatric conditions developing during or after your retreat. We strongly advise purchasing a holiday insurance policy that covers these and other contingencies.

Active Retreats Loyalty Scheme:

Everyone who books and stays at Active Retreats will benefit from our loyalty scheme. Make a booking for yourself plus TWO or more people to receive 25% off the total booking price (if paid immediately in full. The offer is valid until 07.09.2024)

Every guest will receive up to 25% off for the next Active Retreat. The discounts are ONLY off the bed rate and not off any extras such as treatments. In order to qualify for the discount, you must make the booking in your name and personally attend the retreat.

Health Restrictions: By proceeding with this booking, you automatically acknowledge and accept a waiver with Active Retreats.  

General Waiver:

You acknowledge that during any trip with Active Retreats you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any cause of action against Active Retreats, their agents, contractors, employees, and directors, arising from any loss or damage to any person or property that occurs during an Active Retreat up to and including death. If you are currently pregnant, or under medical or psychiatric supervision, you must provide a Doctor’s certificate confirming your fitness to travel and take part in the retreat as well as notifying Active Retreats. Active Retreats is unfortunately not suitable for those with psychiatric or deep emotional issues or those looking for counselling or therapy, as our team is not professionally qualified in these areas. Our team is also not medically trained and do not know your medical history, so cannot offer any specific medical advice whilst at the retreat. Our retreat is not suitable for children under the age of 18 years and for people with physical or mental disabilities who do not function independently as we do not have the resources or expertise. There are areas of the retreat that people with mobility issues may not be able to access.

By agreeing to these terms and conditions, I/we state that I/we wish to participate in the Active Retreats and all the activities. I/we realise that my/our participation involves the risk of injury and even the possibility of death. Furthermore, I/we confirm that I/we are voluntarily engaging in an acceptable level of exercise organisers are not responsible for any injuries or losses incurred whilst at the retreat, after the retreat, or during the transfer.

If I/we suffer from any health conditions, I/we confirm that I/we have either consulted with a doctor before participating in physical activity or I/we am accepting full responsibility for my/our own health and I/we acknowledge the risk involved.

 

Photo / Video Release – Use of Image:

You hereby grant to Active Retreats the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with Active Retreats. You hereby release and discharge Active Retreats from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

This contract is entered into under the laws of the United Kingdom, and in agreeing to these terms and conditions, you are doing so on behalf of yourself and any other parties included in your booking.

By booking any retreat with Us you agree to be bound by and adhere to all policies and rules.
